General Conditions of Sale of Products

Article 1: Preliminary provisions

1. Scope

These General Conditions (hereinafter General Conditions) apply without restriction to all sales concluded by brut.nature.bijoux, registered with the CMA of Beziers under Siret number 95111430500018, with headquarters at Rue Neuve, 34390 Olargues (not subject to VAT), and owned by Mònica Julián Palouzié. The company provides Products, software, and services (hereinafter Services) via www.brut.nature.bijoux.com (the Site).

These conditions define the rights and obligations for the online sale of products to non-professional buyers (hereinafter the Customer or Buyer).

They apply immediately upon publication and do not apply retroactively.

They prevail over other versions or conflicting documents. Specific terms may apply and override these. The Seller reserves the right to amend these General Conditions at any time.

Products are available for sale in the EU and internationally. These terms apply to all purchases from customers in those regions.

1.2 Acceptance of the General Conditions

Placing an order on the Site implies full acceptance of the General Conditions. Conditional acceptance is considered void.

The Customer indicates acceptance by checking a box during each order confirmation.

1.3 Definitions

• The Customer: Any natural or legal person acting outside a professional activity.
• The Order: The sales contract concluded between brut.nature.bijoux and the Customer.
• The Products: Items offered on the Site, marked as sold and shipped by the Seller.
• The Price: Price indicated at the time of order validation.
• Durable medium: Any means of storing information for future reference and reproduction.

2.1 Activity

The company operates in the field of costume jewelry.

Under the French Data Protection Act and the GDPR, the Customer may exercise their rights by written request with proof of identity sent to the Seller’s address.

Article 3: Data Protection

Personal data is required to process orders and prepare invoices. Data is handled in compliance with legal standards and is securely stored.

The Customer may access, modify, rectify, oppose, delete, or transfer their data according to the “Confidentiality and protection of privacy policy.”

Article 4: Formation and execution of the contract

Products are described with maximum accuracy and are subject to availability. If a product is out of stock, the Customer will be notified within 6 working days and refunded within 14 days of payment.

brut.nature.bijoux cannot be held liable for cancellations or postponed product launches if notified on time.

Article 5: Payment

The price at the time of order validation is the applicable price. Prices are firm and not subject to change during their validity period.

Article 6: Product availability

6.1 Delivery

Delivery is the transfer of physical possession or control to the Customer. Products will be delivered within 15 working days unless otherwise specified.

If the delivery date is exceeded (except in cases of force majeure), the Customer may cancel the sale by registered letter, after a reasonable grace period.

The sale is canceled upon receipt of the letter unless delivery was completed in time.

If the delivery time is an essential part of the contract, the Customer may cancel immediately. A full refund will be issued within 14 days of contract cancellation.

If the address is incorrect or the package is unclaimed, the Customer must pay for reshipping.

6.2 Reception

The Customer must check the delivered Products and notify any issues within 3 days, with proof. After this period, Products are deemed compliant.

The Seller will replace any Products with proven defects or non-conformity at no cost.

6.3 Transfer of ownership and risks

Ownership transfers only after full payment. Risks transfer upon delivery or receipt by the Customer or a third party designated by the Customer.

Article 7: Right of withdrawal

The Customer has 14 days after delivery to return the Products for exchange or refund, provided they are unused and in original packaging. Damaged or incomplete items are not accepted.

Once withdrawal is declared, the Customer has 14 days to return the items. A refund will be issued within 14 days after brut.nature.bijoux receives the returned product. Return costs are the Customer’s responsibility.

Personalized products are not eligible for withdrawal under the law.
